Picobello Terms of Service

Publication status: This repository copy is a release candidate, not approved production terms. This version must receive final legal and operator approval and be published before it is treated as effective.
These Terms govern Picobello and its related services. The operator is Picobello Software UG (haftungsbeschränkt), registered office Berlin, with the business address c/o The Base Berlin One, Pestalozzistraße 5-8, Apt. 216, 13187 Berlin, Germany ("Picobello", "we", "us"). The company is represented by its managing director, Felix Parey, and is registered in the commercial register of Amtsgericht Charlottenburg under HRB 291439 B. Contact: support@picobelloapp.com.
Picobello turns family chores into quests and virtual coins. A parent or guardian configures the family and any real-world rewards. These Terms do not reduce mandatory consumer rights.
1. Adult account and agreement
Only an adult who can enter a binding agreement may create a parent account and accept these Terms. By creating a family, the adult confirms that they are authorized to manage the account and child profiles they create.
Users who are legally children do not accept these Terms or create independent public accounts. They use a child profile created and authorized by a parent or legal guardian. The adult is responsible for choosing age-appropriate tasks and rewards, supervising use, maintaining accurate family information and considering the child's interests.
The child label is an app role, not a legal determination that a user is a minor. The role currently supports ages 4–18. A user who is 18, or otherwise legally an adult under applicable law, must receive the authority and rights that apply to an adult. An approved role, authorization and rights transition for that situation remains a release requirement.
Acceptance of these Terms, acknowledgement of the Privacy Policy and guardian authorization are recorded as separate decisions. The Privacy Policy explains the data processing and withdrawal options.
2. Accounts and security
A parent may sign in using a supported method such as email, Sign in with Apple or Google Sign-In. You must provide accurate information, keep credentials and adult access codes secure, use the adult gate responsibly and notify us promptly if you suspect unauthorized access.
Do not share a parent sign-in or co-parent code with a child or an unrelated person. You are responsible for activity performed through your account to the extent permitted by law, but this does not make you responsible for failures caused by Picobello's own security or unlawful conduct.
3. Family setup and child profiles
The parent creates the family, chooses child display names and app-provided avatars, and selects areas, quests, rewards and family settings. Use a nickname rather than a child's full legal name. Do not put medical, religious, location, humiliating or other sensitive facts into profile names, support messages or configurations.
The current family app does not let users upload custom area, quest, reward or profile images. Catalog media is supplied and administered by Picobello.
4. Pairing and additional parents
An authenticated parent can create a six-digit household code for child devices. It is valid for 10 minutes and can be used by multiple child devices while it remains live. Presenting a valid code reveals the active child profiles' names and avatars so the user can select the correct child. Selecting a child can create a revocable child session without a second approval action on the parent's device. The creating parent can see joins and revoke the code or sessions.
A separate co-parent code is intended for one adult who signs in with their own supported adult credential. It is consumed after a successful adult join. A parent must share either type of code only with an intended household member and revoke it if it may have been exposed.
5. Licence
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service on devices you own or control for your household's non-commercial use.
Except where law permits otherwise, you may not copy, sell, rent, redistribute, reverse engineer, interfere with or extract the source code, assets or service; bypass security or rate limits; or use automated tools to scrape or manipulate accounts, quests, coins or rewards.
6. Quests, coins and family rewards
Coins are closed-loop virtual points with no cash value. They cannot be withdrawn, sold or transferred outside the Service.
Tasks, reward eligibility, coin prices and any real-world reward are selected or approved by the parent. Picobello is not the supplier of a family's treats, screen time, outings, money rewards or other household promises and cannot enforce an agreement between parent and child.
We may correct balances or states affected by fraud, duplication or technical error. We will not remove paid value contrary to mandatory consumer law.
7. Recommendations
The setup flow may filter or recommend catalog tasks and rewards using child age, the selected gender/profile value and parent preferences. These suggestions are a configuration aid only. The parent makes the final choice and can choose other available items.
8. Subscription required for new-family activation
Under the current setup flow, an active auto-renewable subscription or trial is required to activate a new family. The App Store shows the price, billing period, trial terms if any and included features before purchase. Apple processes payment under the App Store terms.
Unless cancelled at least as required by the App Store before renewal, a subscription renews automatically. Manage or cancel it through the Apple account subscription settings. Restores and family transfers are subject to entitlement verification and one-family binding intended to prevent duplicate use. Mandatory withdrawal, refund and consumer rights remain unaffected.
9. Notifications
Notifications are optional. If enabled, they may include family event, task or reward information and may appear on the device lock screen according to operating-system settings. You can disable them in the app or device settings without losing the core quest experience.
10. Acceptable use
You must not:
- use the Service unlawfully, fraudulently or in a way that harms or exploits a child;
- attempt to access another family, impersonate a guardian or connect a device without authorization;
- disclose pairing codes, session credentials or export links to unauthorized people;
- probe, disrupt, overload or bypass the Service's security;
- manipulate quests, balances, purchases, redemptions or subscriptions dishonestly;
- introduce malicious code or use bots, scrapers or automated attacks; or
- use profile or household fields to demean a child or store unlawful or unnecessary sensitive information.
Good-faith security reports sent privately to the support contact are not prohibited by this section.
11. Intellectual property
The Service, software, design, text, artwork, characters, catalog content and trademarks belong to Picobello or its licensors. These Terms grant only the limited right to use the Service and do not transfer ownership.
You retain rights in the limited information you provide. You authorize us and our contracted providers to host, copy, synchronize and otherwise process it only as needed to provide, secure and administer the Service and comply with law, as described in the Privacy Policy.
12. Privacy and children
The Privacy Policy forms part of the information governing the Service. It describes child and parent data, same-family visibility, providers, transfers, retention, rights and deletion.
Creating a guardian record does not by itself prove that every country's child-consent or age-assurance law has been satisfied. Availability for additional markets may be limited until the required method and notice have been approved.
13. Third-party services and app stores
The Service relies on Apple and Google/Firebase for functions such as distribution, authentication, cloud hosting, synchronization, attestation, notifications and subscriptions. Interruptions or changes to those services can affect Picobello.
For an app downloaded from Apple's App Store, these Terms are between you and Picobello, not Apple. Apple is not responsible for maintaining or supporting the Service. Apple and its subsidiaries are third-party beneficiaries of the licence terms to the extent required by Apple's rules. Mandatory claims and rights against Apple or Picobello remain governed by applicable law.
14. Availability and changes
We aim to keep the Service available but do not promise uninterrupted or error-free operation. Maintenance, security incidents, legal requirements, provider outages or product changes may temporarily limit it.
We may change, suspend or discontinue features where reasonably necessary. When a change materially disadvantages an active paid subscription, we will provide the notice or remedy required by applicable consumer law.
15. Suspension and termination
You may stop using the Service and request account deletion at any time. We may restrict or suspend access where reasonably necessary to address a material breach, security threat, fraud, child-safety concern, legal requirement or risk to another family. Where appropriate and lawful, we will provide notice and an opportunity to correct the issue.
Deletion and termination end the licence. Provisions concerning intellectual property, lawful records, disputes and liabilities survive only to the extent necessary.
16. Disclaimers and liability
Picobello is an organizational and motivational tool, not professional medical, psychological, educational or legal advice. Parents remain responsible for the safety, suitability and supervision of household tasks and rewards.
We provide the Service with the care required by applicable law. To the maximum extent legally permitted, we do not guarantee that it will always be available, meet every family's needs or prevent every unauthorized act.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for intent, gross negligence, death or personal injury where applicable, or mandatory consumer and product rights. Any other limitation applies only to the extent permitted by the law governing the individual claim.
17. Governing rules and disputes
The mandatory consumer and data-protection laws that apply under the relevant conflict-of-law rules remain in force. These Terms do not take away the protection of the mandatory law or courts available at a consumer's habitual residence.
Please contact support@picobelloapp.com first so we can try to resolve a problem informally. This does not restrict access to a competent court, supervisory authority or mandatory dispute-resolution route.
18. Changes to these Terms
We may update these Terms for legal, security, provider or product changes. We will change the version and date and give reasonable advance notice for a material change where required. If consent or renewed acceptance is legally required, continued use alone will not replace it.
19. General
If part of these Terms is unenforceable, the rest remains effective. A failure to enforce a provision is not a waiver. We may transfer the Service as part of a legitimate reorganization or sale only subject to applicable consumer and child-data obligations.
